Robert Jenkins' lawsuit against Joe Anderson dismissed

This is a press release sent out by Joe Anderson, titled Freedom of Speech Preserved in Snellville.

Former Snellville City Councilman and long time homeowners’ advocate, Joe Anderson, has received word from his attorneys that the lawsuit brought by now former Snellville Councilman Robert Jenkins has been dismissed and all opportunity for appeal exhausted. “I am delighted that my legal team successfully defended the First Amendment and the rights of all citizens to redress government on issues of concern. As Americans it is so important that we feel free to speak the truth about politicians and their actions in office.” said Anderson.

Anderson’s complaint lodged in 2007 with then Interim City Manager Jim Brooks noted that Jenkins was living in a home owned by a developer, while voting on zoning text changes intended for the property he was living in, along with surrounding land. Jenkins amended the new ordinance to remove all requirements for green space, thus increasing the allowable density of the zoning classification. After the complaint was filed Jenkins recused himself from voting on the actual rezoning of the developer’s property, but declared that he had no conflict of interest in the matter. He had earlier voted to approve a similar zoning classification on an adjoining property.

Jenkins testified in his pretrial deposition that he was paying the developer $500 per month in cash for the 4-bedroom 3-bath home in 2007. Jenkins also stated that no lease, canceled checks, or cash receipts were available for the rental of the home located on Hamilton Drive in Snellville in the Brookwood school district.

“My wife Sydney and I are delighted to have this behind us now, we feel quite vindicated and happy to know that the truth remains a viable defense” said Anderson. “We want to thank our legal team and our many friends who provided moral support. I can now focus my full attention to serving the homeowners and small business people in central and south Gwinnett.” Indeed Anderson is now a candidate for State Senate District 9, which covers an area east of Lilburn, all of Snellville, Lawrenceville and Grayson and some the southeastern side of Loganville.

Anderson is a small business owner, and has been a resident of Gwinnett County for 24 years. Anderson has served his community on the Snellville/Gwinnett County Transportation Study Team, the Snellville Planning Commission, the Atlanta Regional Commission MIS on US 78, the Citizen Project Selection Committee for the 2001 SPLOST, and was twice elected to the Snellville City Council. Joe and Sydney, his wife of 29 years, are active members at Cannon United Methodist Church.
